US Congress Demands Explanation for Anthropic Export Restrictions

Four members of the U.S. House of Representatives (from both the Democratic and Republican parties) sent an official letter to the Department of Commerce asking about the basis for the export restriction measures on Anthropic models.

The members demanded answers on the following key points:

• Procedural legitimacy: Whether the interagency consultation and notice procedures required under the relevant law (50 U.S.C. § 4817(b)(2)(B)) were followed before designating the model as a controlled emerging technology
• Basis for risk assessment: The specific factual basis for the determination that the model poses a risk of being used for "military intelligence end use"
• Fairness concerns: Whether there are unique capabilities that apply only to Anthropic's specific model, or whether the same capabilities exist in other publicly available models (including open weight models)
• Prior communication: Whether there was any prior communication requesting voluntary suspension or correction with the developer (Anthropic) before the official directive was issued
