Hugging Face Publishes Policy Recommendations on the EU AI Act

Hugging Face, together with Creative Commons, GitHub, Eleuther AI, and others, published a Position Paper stating that the EU AI Act should fully reflect the nature of open-source and collaborative ML development.

The key recommendations are as follows:

• Clear definition of AI components: Clearly distinguish which AI components are subject to regulation.
• Exemption for open-source developers: Specify that developers who share and collaborate on open-source AI components in public repositories are not subject to legal regulation.
• Inclusive governance: Have the AI Office collaborate with the open-source ecosystem to build inclusive governance.
• Meaningful R&D exemption: Allow limited testing in real-world settings so that the research and development (R&D) exemption clause is effective in practice.
• Proportionate requirements for foundation models: Apply differentiated levels of regulation to Foundation Models according to their varying development methods and uses, including open-source approaches.
