Our Response to the UK's Copyright Consultation

For the UK to leap forward as Europe's AI hub, a clear regulatory framework that does not hinder technological advancement is essential. OpenAI has proposed introducing a broad TDM (Text and Data Mining) exception, 'Option 2' in the consultation, so that the UK government can maximize the benefits of AI.

This proposal is based on three core principles.

• Data Accessibility: Access to data is a key element for AI-driven economic growth and investment, and an essential foundation for the UK to grow into a global AI leader.
• Balancing Innovation and Rights Protection: A broad TDM exception can operate in a way that promotes investment in AI infrastructure while also addressing copyright holders' concerns and creating new opportunities for creation.
• Eliminating Policy Uncertainty: Instead of the EU's opt-out approach, which causes uncertainty due to inadequate technical standards, a clear and predictable regulatory environment should be established.

The UK stands at a crossroads: choosing whether to achieve breakthroughs in education, science, and healthcare through innovation, or to cede AI leadership to other countries.
