OpenAI Rebuttal to Apple Lawsuit

OpenAI strongly rebutted the trade secret theft lawsuit filed by Apple, arguing that Apple's own security policies and management failures were the root cause of the issue. OpenAI pointed out that while Apple encouraged employees to use personal iCloud accounts for accessing work documents, it failed to provide sufficient time for device return or file transfer upon resignation, leading to a situation where personal and company data became commingled.

Apple filed a lawsuit in July against OpenAI and former employees Tang Tan and Chang Liu, alleging misappropriation of trade secrets related to hardware design, manufacturing, and supply chain operations. OpenAI counters that this lawsuit is intended to restrain competition and prevent talent attrition, infringing upon the freedom of employee mobility permitted by California state law.

According to both parties, approximately 400 individuals have left Apple for OpenAI's hardware division. The hearing on Apple's request for expedited discovery is scheduled for October 1.
